I nominate Monrovia Councilmember Tom Adams for the Grinch of the Year Award for timing his resignation from the City Council to fall after December 21st, 2008 thereby depriving the community of their Democratic right to vote a replacement to his seat on the City Council without calling for an expensive special election in these trying economic times.
If Tom Adams resigned on or before December 21st, 2008 the current council would have the option of placing his seat on the ballot for the April 14th, 2009 council election or appointing a replacement of their choice.
With two incumbent council members running for their council seats and another councilmember running for the Mayors seat I doubt that they would do anything other then place the vacant seat of Tom Adams on the 2009 council election and let the community decide who will fill out the remaining term of that seat. If they did otherwise they would probably be committing political suicide in the community.
The very divisive timing of his resignation on April 30th, 2009 will allow the currently seated council the opportunity to select a replacement to fill his vacated seat after the 2009 election is over if they decide to do so. There is one council meeting after the council election April 14th, 2009 and the certification of the election results and instillation of any new council members and Mayor on May 5th, 2009 in which the current council members could opt to make an appointment and not worry about the fallout affecting their reelection results. This would allow the current council to influence the power structure of the council for their purposes.

years, it was the least I could do.
I know the decision to resign has confused many, not only for the
reason but also what do we do next? Since this doesn’t happen very often, please
allow me to help think it though.

If I resign now, the current council, the one you take issue with
so frequently, will decide what to do. They have every right to appoint someone
to fill the balance of my term, that being the next 28 months or so.
(Cyrus replies) Tom, the current council will have time to appoint
someone to finish your term after the election and before the new council is
sworn in ,so the current council will decide what to do if they choose to and
because of your help. If they appointed someone to finish your term before the
election, the political fallout would probably cost them the election and you
and they know that. If you really wanted the newly elected council to make the
appointment you would wait until after they were sworn in, may 5th,
2009 to resign your seat.
If I resign after the election in April, the next council, the
one you claim to have candidates that will be successful, will appoint my
replacement.

I thought I was doing you a favor by allowing the “new” council
to make that choice. Apparently there was a lack of critical thinking on your
part.

letting them decide. No lack of critical thinking on your part, you and the
boys thought this through very carefully and the only loser is the communities
lose of the Democratic process.
You see , if there was any conspiracy, waiting to make my
announcement until April would have fooled everyone. Making the announcement in
November allows everyone to gear up if they want. Choices are at times confusing
and for that I apologize.
(Cyrus replies) Tom, no confusion here, if you had resigned cold
after the election but before the new council was seated and the current council
appointed someone on their way out that would have made your resignation look
even more like a well timed conspiracy.

(Cyrus replies) Tom, my only confusion is why you want to deprive the
community of the Democratic process by not resigning before the 21st
of December and letting the current council place your seat on the ballot for
2009 or losing their bid for re-election by appointing some before the election,
they would be forced to do one or the other and if they did not place your seat
on the ballot then they would be the ones depriving the community of the
Democratic process and it would probably cause them to lose the election.

If the election is April 14th and I resign on April 30th do you
really think do you really think they would appoint someone on May 5th? The
reason I even responded was because your article said I was resigning March 30th
not the April 30th that my resignation stated.

people will do desperate things under the right circumstances.
Let’s play
devils advocate.
One council
seat and the Mayors seat are won by two new people leaving two incumbent
councilmember’s in their seats. If the two new councilmember’s are not part of
the status quo the future balance of power could change depending on the
councils pick to finish your term. The power structure might remain status quo
or take a major shift or we could end up with a 2/2 vote stalemate and the seat
would have to be put out for very expensive special election.
But before
the new council is seated the current council minus you, could select your
replacement with very little fallout because the election is over. You would
have two votes from departing council members Rod Hammond plus either Garcia or
Kirby with nothing to lose and if the other of Garcia or Kirby who was
re-elected went along for the third vote the community would have Four Years to
forgive or forget their transgression.
They would
have nothing to lose and much to gain by keeping the status quo in power. They
have the legal right and they could do it at the start of the regular meeting or
call for a special meeting noticed on Friday the 1st for Monday the 4th
at a time when few people would know or be able to speak to the item and
once done it can’t be undone except by recall.

the heads up on the date, my mind typo, but it changes nothing I have stated.
If you really
want to do the right thing you will resign now and allow the boys to make their
own mistakes if they choose to appoint or place your seat on the ballot. If
they appoint they will lose even bigger.
